Platinum Yoga
Platinum Yoga is operated by Platinum Yoga Pte Ltd, with it’s registered address at 1 Marine Parade Central, Parkway Centre, #13-09, Singapore 449408 (“The Company”). The principal objective is to provide yoga classes for its Members. The Company has appointed a Management team (“The Management”), who are responsible for the operation of the studios in accordance with these Rules.
Membership Terms
a) The Management reserves the right to accept or reject an application for Membership for any reason whatsoever. Members are subjected to the Studio Rules and Regulations in force.
b) Membership is personal to the Member and is non-assignable, non-transferable and non-refundable. Subject to the Management’s approval, some Memberships may be transferred to a non-member (one who does not have an account with Platinum Yoga and/or who has no record in Platinum Yoga’s system) for a chargeable administration fee.
c) Upon acceptance of the member’s application, the Member will be issued with a Membership account, and the Member shall be entitled to all the rights and privileges exercisable within the class of membership of which the membership applied by the member has been accepted. Due to safety and security reasons, members are encouraged to update their account profile picture. Members who choose not to update their profile picture will be issued a Membership Card, but should the Membership card be lost or misplaced, and/or irretrievable to that effect, the Management shall have the right to issue a replacement of the membership card at a processing fee.
d) Any member entering the class without a membership card, or without an updated profile picture shall be solely admitted by the Management’s discretion.
e) Management reserves the right of admission/selling/renewing contracts of services & products for whatever reason (provided/not provided), as they have a right to their premises/services as well as freedom of association.
Membership Fees
a)The member agrees that he/she is of legal age, has the capacity, and has voluntarily entered into this agreement. If the member is not of legal age, the member has obtained the consent of the guardian to enter into this agreement. The member agrees to pay the dues and fees as stated in the contract. Joining Fee and administration fees will be charged when a member buys a membership. These fees and any prepaid monthly dues are not refundable, regardless of whether the facilities are being used.
b) A monthly Membership fee (‘dues’) is payable in advance by autopay. The Company reserves the right to charge a nominal fee of $10.70 in the event of an unsuccessful collection of autopay due to members bank account error or otherwise.
Membership Termination
a) The Company reserves the right to terminate the Membership of any Member found to be in breach of any Terms and Conditions/Centre Rules and Regulations. The Member has to pay for the full membership and shall not be entitled to any refunds.
b) In case of permanent disability, the Member will be entitled to claim a pro-rated amount by making a request for refund within thirty (30) days from the date of such disablement. Any such request for a refund must be accompanied by a document in writing from a certified physician. The definition of permanent disability is a condition of non-temporary nature, which will preclude the member from physically using the yoga center facilities for the remainder of the term of the Membership and is documented in writing by a certified physician. The termination date will be the daye which the proof by the physician is received by The Company. The member agrees that the Membership shall not be terminated except by the Member in person. In case of death, the Membership shall be terminated and the Member’s family members will be entitled to make a joint application to claim a pro-rata amount within 30 days of such death. Such joint application must be accompanied by the death certificate of the Member.
Physical Condition of Member
a) The member hereby warrants represents and agrees that he/she has no physical disability, impairment or ailment preventing him/her from engaging in any exercise activity, or that will be detrimental to his/her health, safety, comfort, or physical condition, or that of others.
b) The member further undertakes that he/she will consult his/her physician before undertaking an exercise program. The Member fully understands that he/she is engaging in physical exercise and training and instruction by The Centre’s personnel, which may cause injury or a risk of abnormal body changes to him or her. He/she hereby agrees that he/she is a voluntary participant in physical exercise, the use of any facility of the yoga center, training and instruction by the center’s personnel and that he/she is assuming all risks of injury or of abnormal body changes to him/her on account of these activities.
c) It is further agreed that The Centre will not perform any evaluation of the members physical condition, which might result in the identification of the risk factors contradicting or prohibiting physical exercise prior to his/her starting or continuing any exercise activity. The center shall not be liable or responsible for any injury or abnormal body changes caused as a result of the use of the centers facilities and training and instruction by the center’s personnel.
d) The member shall not use any studio facilities whilst suffering from any infections or contagious illness, disease or other ailments such as open cuts, abrasions, open sores or minor infection, where there is a risk that such use may be detrimental to the health, safety, comfort or physical condition of other members.
Expulsion of Member
(a) Platinum Yoga and/or the management may terminate the membership of any member:
(i) without notice and with immediate effect if the member’s conduct, whether or not such conduct is the subject of a complaint by another member or members, such that in the opinion of the management, and conduct may be injurious to the interests of the company.
(ii) without notice and with immediate effect if the member shall have committed any breach of these Terms and Conditions or of the Company’s Rules and Regulations that are in force at the material time.
(iii) if any monthly membership fees, locker fees, or service charges remain unpaid after the due date for payment
(iv) with and/or without notice and with immediate effect, if the company is of the opinion that the member is not a suitable individual for continued membership. All decisions of the management under this clause are final and binding.
(v) without notice and with immediate effect if a member is found to have violated the privacy of any other member within the shower and the changing rooms, or are caught in lewd or compromising actions
(b) The company has the right to terminate any membership with or without notice/explanation. This may be done by refunding the prorated advance payment. A member whose membership is terminated by the management shall forfeit all the privileges of membership with immediate effect. On termination of his/her membership, the member shall return forthwith his/her membership card and any other evidence or property of membership provided to the member and shall settle any outstanding debts.
(c) Please treat our staff and fellow yogi members with respect. We aim to provide a safe environment for our staff and members, therefore, we expect all members to respect the rights of staff and of other members. The use or threat of force against our staff, or any attempt to do so, is unacceptable. This includes any forceful or unlawful touching of any other person, spitting at another person, raising fists or feet or verbally threatening to strike or otherwise applying force to any person.
Aggressive or abusive behaviour against our staff is unacceptable. This includes swearing, threatening or abusive language or gestures, sexual gestures or behaviour, derogatory sexual or racial remarks, shouting loudly or in an intimidating manner or at any person, and applying force to any studio property or the personal property of any staff, such as banging on or kicking desks or counters.
The company can terminate any membership with or without notice/explanation and with immediate effect if member is found to have been disrespectful to our staff.
Membership Suspension
a) If a member is on a monthly committed autopay, You may suspend your Agreement for a maximum of twelve (12) months if you are pregnant or for a maximum of three (3) months in a calendar year for any other reason. The minimum suspension period is one (1) month. You are allowed to suspend your Agreement twice within a calendar year.Supporting documents from approved medical practitioners must be produced for verification purposes.
b) All non-pregnancy or non-medical suspensions will be charged at $53.50 per month (including 7% GST). Suspension fee may be increased at any time at the discretion of the Management.
c) If a member is on a monthly committed autopay, the package expiry date will be extended by the number of month(s) suspended. Member must give at least thirty (30) days notice prior to the next scheduled autopay date for his/her suspension to be approved.
For example you have signed up for a 12 month Giro and then auto renewed membership and you want to suspend 7,8,9th month due to your personal reason. it will work like this?
There will be no change in your first 12 billing cycles of your membership fees as you must complete the minimum membership period. You will have no deduction or only charged suspension fees on your 13,14 and 15th month. From 16th month onwards you will be charged normal membership fees.
d)All our prepaid memberships are non-flexi membership which means there will no suspension except for pregnancy related.
e) No backdated suspension is allowed. Suspension fee is non-refundable and non-transferable.
f) Platinum Yoga and/or the management may suspend/terminate the membership of any member:
(i) without notice and with immediate effect if the member’s conduct, whether or not such conduct is the subject of a complaint by another member or members, is such that in the reasonable opinion of the management, it may be injurious to the character or interest of the company.
(ii) without notice and with immediate effect if the member shall have committed any breach of these Terms and Conditions or of the Company’s Rules and Regulations as are from time to time in force.
(iii) if any monthly membership fees, locker fees, or service charges remain unpaid after the due date for payment
(iv) with and/or without notice and with immediate effect, if the company is of the opinion that the member is not a suitable individual for continued membership. Management is not liable to give any reason for the same. All decisions of the management under this clause are final and binding.
(v) without notice and with immediate effect if a member is found to have violated the privacy of any other member within the shower and the changing rooms, or are caught in lewd or compromising actions
Operating Hours
Please call the individual studios for the operation hours. The Management reserves the right to adjust the hours for purposes of cleaning, decorating, repairs, special private functions and holidays. The Management shall endeavour to give reasonable notice of any change in operation hours.
Dress Code
All Members are required to wear suitable yoga attire.
Studio Facilities
a) Members can use our shower facility, however clients are to bring their own bath towel.
b) Certain complimentary drinks are provided to members for consumption within the premises only. These drinks are for refreshment on the premises only. Members are not allowed to bring their own food and/or drinks into the studio.
c) The Management may from time to time wish to show potential Members or others around the studio and allow them to use the studio facilities on a trial basis and reserves the right to do so.
d) No photography / video taking is permitted within the premises unless authorized by the management of Platinum Yoga. Members are strictly not allowed to take photographs in the changing room to protect the privacy of others. Members breaching this rule will be handed over to the Authorities to be dealt with accordingly.
Lockers
a) A locker facility is provided to each member & guest during each visit. The locker must be vacated before leaving the studio and any items left overnight will be disposed accordingly.
b) Management cannot guarantee against the occurrence of theft or damage to your belongings with the use of the locker, and will not accept responsibility for loss or damage to contents with the locker.
Provision of Personal Data
Platinum Yoga is absolutely committed to the protection of privacy and to fully implementing and complying with the relevant provisions of the Personal Data (Privacy) Ordinance.
Personal Data Collected
Platinum Yoga collects different information in order to help us improve the services and products we offer; and to provide unique personalised services and products to each registrant.
Platinum Yoga collects information on you when you enter a user agreement with Platinum Yoga and when you register with the Platinum Yoga website.
You are under no obligation to provide your complete personal data. However, the minimum information we require for us to be able to provide you with our products and services are your name, phone number, and e-mail address.
Platinum Yoga may also ask for further information from you in order to obtain a better understanding of how Platinum Yoga can provide personalised services to you, in all instances it is entirely your choice whether or not to provide information. In cases for us to provide the service requested, you will be required to give certain information. If you choose not to provide the required information, we may not be able to provide the services requested, in all cases when you are required to give information we will inform you. We will inform you in cases when it is obligatory for you to provide information before you can receive the service requested.
Types of Information we collect:
- Your attendance record;
- Your purchase history;
- Your name, residential address, mobile phone number, office number, emergency contact, emergency contact number, email, country, gender, marital status, passport number, profile photo, designation, company name and address;
- Your credit card details, payment details including type of payment;
- Your workout action plan and goal;
- Which year(s) you may have joined Platinum Yoga;
- How you heard of Platinum Yoga;
- Community discussions, correspondence through our sites and correspondence sent to us;
- Other information from your interaction with our sites, services, and content, including computer and connection information, statistics on page views, traffic to and from the sites, ad data, IP address and standard web log information.
We use your Personal Information:
- To process your application and registration;
- To process your contract renewal and upgrade;
- To conduct market research and analysis;
- For direct marketing;
- To ascertain if you are eligible for discounts;
- For other related purposes
Processing of Your Personal Information
Platinum Yoga forms part of a group of companies and in order to carry out the functions described above it may from time to time be necessary to transfer your personal information to our holding company, subsidiary company, associated companies, and companies which are subsidiaries of our holding company.
Should you not want Platinum Yoga to use your personal data for aforesaid purposes or choose not to receive promotional materials from us, please opt-out by email to marketing@platinumyoga.com.
Others
a) The Management reserves the right to use any individual or group photographs of Members and/or Guests for press or promotional purposes.
b)The inaction of the Management or the Company to enforce any of their respective rights at any time for any period shall not be construed as a waiver of such rights.
c) These Rules shall be governed and constructed in accordance with the laws of Singapore and subjected to the jurisdiction of Singapore.
Limitation of Liability
In consideration for the Management accepting his/her application for membership and for him/her becoming and remaining a member, the member agrees that:
a) Neither Platinum Yoga Pte Ltd, its employees or agents shall be responsible for any claims, demands, injuries, damages, or actions for negligence arising on account of death or due to injury, loss, damage or theft to a member’s person or property arising out of, or in connection with the use by a Member of any of the services, facilities or premises of Platinum Yoga. The Member hereby does not hold the Company, its related company employees and agents harmless from all claims which may be brought against them by or on a Member’s behalf for any such injuries or claims aforesaid.
b) Any guest of a member or temporary visitor to Platinum Yoga agrees to abide by the same studio rules and regulation, and the same terms and conditions as a member.
Liability Waiver
The Member has carefully read this clause and fully understands this as a release of any and all future claims of whatsoever nature against the Centre including but not limited to injury or risk of injury or a risk of abnormal body changes resulting from activities while utilising the Centres facilities and/or undertaking classes in the Centre, save for wilful misconduct or gross negligence by the Centre. PDPA:I am aware that by signing up for this product or service, I am consenting to Platinum Yoga Pte ltd & its related corporations,& their authorised service providers collecting,using & disclosing my personal data,& sharing such personal data with their business partners, for marketing & promotional purposes. I may withdraw such consent at any time via forms available at Platinum Yoga branch.In addition, by selecting any of the boxes above, I also consent to Platinum Yoga Private Limited contacting me via (i) telephone call and/or (ii) SMS and other phone number-based messaging, about products and services offered by Platinum Yoga Private Limited, its business partners and agents, regardless of my registration(s) with the Do Not Call registry. I also agree on the centre terms & conditions/studio rules and regulations/privacy policies which can be found from the Platinum Yoga website .In checking the box below I agree that Platinum Yoga is in no way responsible for the safekeeping of my personal belongings while I attend class. I understand that classes at may be physically strenuous and I voluntarily participate in them with full knowledge that there is risk of personal injury, property loss or death. I agree that neither I, my heirs, assigns or legal representatives will sue or make any other claims of any kind whatsoever against or its members for any personal injury, property damage/loss, or wrongful death, whether caused by negligence or otherwise. Photo Waiver:I am consenting to Platinum Yoga Private Limited using and disclosing to capture my image and likeness in photographs, videotapes, motion pictures, recordings, or any other media (collectively “Images”) for their marketing purpose. I acknowledge that Platinum Yoga Pte Ltd will own such Images and further grant the Platinum Yoga Pte Ltd permission to copyright, display, publish, distribute, use, modify, print and reprint such Images in any manner whatsoever related to Platinum Yoga Pte Ltd business, including without limitation, publications, advertisements, brochures, web site images, or other electronic displays and transmissions thereof. I further waive any right to inspect or approve the use of the Image by the Platinum Yoga Pte Ltd prior to its use. I forever release and hold the Platinum Yoga Pte Ltd harmless from any and all liability arising out of the use of the Images in any manner or media whatsoever, and waive any and all claims and causes of action relating to use of the Images, including without limitation, claims for invasion of privacy rights or publicity. By electronically signing or otherwise electronically accepting and agreeing to this Release and Waiver of Liability (this “Release”), you expressly acknowledge that the use of the facilities, classes, livestream or videos of Platinum Yoga Pte Ltd and its subsidiaries and affiliates (collectively, “PlatinumYoga”) may involve strength, flexibility, aerobic, cardio, and/or other exercises, Including the use of equipment, as well as soft tissue manipulation or manual adjustments (which may Include the instructor, assistant, trainee, or mentee, guiding your body to a pose or specific movement), all of which can be potentially hazardous activities that naturally involve the risk of injury to you, whether you or someone else cause it, and you understand and voluntarily accept this risk. In addition, you represent that you are (and at all times moving forward, when taking classes or receiving instruction by or through PlatinumYoga) in good health and have no disability, impairment, injury, disease or ailment that would prevent you from safely engaging in active or passive exercise or soft tissue manipulation or which would cause increased risk of injury or adverse health consequences as a result of engaging in active or passive exercise , and you further acknowledge and understand that it is your duty to notify your PlatinumYoga teacher in advance of each and every class of any changes in your good health standing. You acknowledge and agree that PlatinumYoga and its employees and agents do not diagnose or prescribe treatment for any illnesses or injuries. No service provided by PlatinumYoga is a substitute for medical treatment or care. Please inform your PlatinumYoga teacher in advance of each class if you prefer not to receive manual adjustments. Failure to do so will be deemed implied consent to receive manual adjustments in a class. All sessions, classes, use of Platinum Yoga studio facilities (or entry/exit of such facilities), use of PlatinumYoga studio-provided equipment or apparatus (whether during a class or otherwise), or use of any other PlatinumYoga service, whether in person, through video or stream or otherwise, shall be at your sole risk. You understand that the decision to use any equipment or apparatus, or the selection of programs, methods and types of equipment, shall be solely your responsibility, and at no time may you use any equipment without supervision by a PlatinumYoga teacher. Although PlatinumYoga instructors may provide guidance during a class or individual session, it is your sole responsibility to discontinue participation in any activity you feel is beyond your capability to safely perform. You hereby acknowledge and agree that PlatinumYoga shall not be liable to you or any other party for any claims, demands, damages or causes of actions due to injury to you or any property, including, without limitation, personal, bodily or mental injury, economic loss or any damage to you, your spouse or partner, guest, unborn children or relatives, arising out of or in connection with your engagement in any activities provided by PlatinumYoga through video, streaming, or at any PlatinumYoga’ facility, the use of the services or facilities of PlatinumYoga, or any occurrence in or around a PlatinumYoga facility, regardless of whether the injury or damages were caused by the negligence of PlatinumYoga, its employees or its agents, trainees, assistants, or mentees, and you hereby release PlatinumYoga from any and all liability related thereto, Including any transmission of sickness, virus, pathogen, or disease. This Release specifically applies to claims of negligent instruction, maintenance and/or supervision that may arise as a result of injuries sustained before, during, or after classes or individual training sessions. You acknowledge and agree that this Release applies to any and all incidents occurring on any PlatinumYoga owned, operated or controlled premises, Including slip or trip and fall incidents, regardless of the cause. You further acknowledge and agree that PlatinumYoga is not liable and does not assume responsibility for any claims, losses, damages, costs or expenses arising out of any inconvenience, loss of enjoyment, upset, disappointment, distress or frustration, whether physical or mental, resulting from any act or omission of PlatinumYoga or any other party. The scope of this Release specifically includes any and all injuries sustained in or about the premises of any PlatinumYoga facility and during any event or program organised or operated by PlatinumYoga away from its facilities, including, without limitation, parks, beaches, community centers and schools. Further, you understand and acknowledge that PlatinumYoga does not manufacture any of the fitness or other equipment at its facilities but purchases or leases equipment from third parties. As such, you acknowledge and agree that PlatinumYoga is solely providing recreational services and may not be held liable for defective products. You expressly acknowledge and understand that you will be automatically opted into communications from PlatinumYoga with regard to the services provided, branding, marketing, or anything else and that it is your duty to opt out through the procedures outlined in such communications. You further expressly acknowledge and understand that your photo and/or video likeness may be used, without limitation, in connection with publicity, copyright, marketing, web content, social media, live stream, recorded classes, or other uses and that permission is expressly granted for such uses, and that no additional consideration outside of the services provided by PlatinumYoga will be provided.

In the event that a dispute does arise with respect to PlatinumYoga in any capacity, you expressly acknowledge and agree to submit to mandatory binding arbitration any and all such related claims, and thereby further waive any rights to trial by jury. Further you expressly acknowledge and agree to waive any rights that you may have to pursue or participate in a class or collective action pertaining to any such claims related to PlatinumYoga. This Release is intended to be interpreted as broadly as allowed under the law of Singapore or where your primary PlatinumYoga facility is located. By electronically signing or otherwise electronically accepting and agreeing to this Release you certify that you have carefully reviewed, fully understand and agree to the above.
